TERMS AND CONDITIONS OF USE OF THIS WEB SITE

General

Use of this website constitutes acceptance of these terms and conditions of use [referred to in this web site as “Terms and Conditions”] that are outlined below.

The material contained in this web site is owned by Atlantic Salmon Access Point ASAP Inc. [ASAP] or under licensed to it and is protected by copyright and trademark and unauthorized use without the specific written permission of the ASAP or the owner is prohibited.

Users of this site have the right , are licensed and are invited to use this site for the purposes of accessing the services and information contained here and for no other purpose without written permission.

The information, including products, services and prices, may be changed at any time and the information included on the web site is not warranted to be accurate or up-to-date by ASAP nor does ASAP accept any responsibility for any linked sites or for any liability for claims arising from the use of the site.

Angling Agreements

By accepting these terms and conditions the Angler acknowledges that Atlantic Salmon angling and angling generally is an activity that involves certain risks and the Angler agrees to accept those risks and to release ASAP and the Owner/Proprietor of the pool and angling rights from any liability.

Angling rights are purchased on terms and conditions contained in a detailed “ANGLING AGREEMENT AND WAIVER” which can be downloaded from the Pool Profile and which must be reviewed carefully without rushing and accepted prior to booking. The ANGLING AGREEMENT AND WAIVER must be carried by the angler and produced if requested by [a] ASAP; [b] by the Owner /Proprietor or by [c] other Anglers if the number of anglers in a pool exceeds the guaranteed maximum number.

Non-Angling Guests must also sign a waiver before entering the pool property.

Pricing

The prices for fishing are set by the owner/proprietor of the pool and are quoted in Canadian dollars and are subject to HST. We encourage all owners to give good value and to price according to the fishing quality, historical data and feed back from previous users.

Owners are free to change their prices at any point up until a confirmed booking [receipt of payment by ASAP].

We anticipate that many of our listings will be last minute and an owner may discount the price because it is a last minute sale or they may set a premium price because the pool is full of fresh taking salmon

The price of all other products or services and the terms and conditions of the sale are set my product or service provider and ASAP accepts no responsibility for disagreements between the vendor and the purchaser.

The parties are persons who: (a) want to use and accept electronic information and agreements; (b) By the act of inserting our names and making a copy available to each other we are intending to provide our signatures on this agreement and bind ourselves to the terms and conditions contained herein; (c) No Party has done, nor will do anything in the future to inhibit the printing or electronic storage by the other of this agreement or any valid amendment hereto; (d) We have carefully reviewed the agreement in a timely manner and there are no material errors contained in it and we have been given full opportunity to review it and prevent or correct any errors. This foregoing statement is not intended to preclude execution of this agreement by any method lawful under N.B. law.

Warranties

There is no warranty or guarantee of catching an Atlantic salmon.

All pool owners warrant the maximum number of rods fishing the pool at any time as identified in the pool profile.

All other warranties applicable to any service or product listed for sale on this site must be specifically obtained from the vendor of that product or service.

Angling Protocols

Etiquette

All anglers agree to exercise the following angling etiquette:

• Share the pool in a civil and respectful manner with all others entitled to fish there
• Anglers arriving at the pool start at the back of the line of fishers already there
• Rotate through the pool taking 2 or 3 casts and a good step [more than a pace and less than goosestep- no shuffling

• Allow an angler who is working a fish a little more leeway but there should be no hogging of fish or hotspots and be courteous if the person behind you catches your fish!
• Do not wade out deep in the pool if you do not know the lies. Salmon often lie in shallow water. Stay 20- 30 feet back from the closest fish.
• If someone hooks a fish give them room to play the fish and reel up while they pass down river or to the beach
• If an angler has a hook up they should fight the fish from the shore and opposite or slightly down river of the fish
These angling protocols can only be varied if all anglers in the pool are agreeable and the owner/proprietor does not object

Communication

We would encourage you to introduce yourself to the other anglers present on the pool, especially in the event of anglers beyond the agreed number and confirming each others credentials including the assigned permit number and provincial angling licence.

Disagreements

ASAP will referee any differences between pool owner and angler and will address any dispute as soon as possible based on the information available [which information it is the parties responsibility to provide] and before making payment and its decision is final.

Cancellation Policy

Payment is non refundable and substitutions are allowed provided the replacement person or persons have fully completed the Angling Agreement and Waiver and they have been received by ASAP prior to the commencement of angling.
